In complex neurological claims, overlapping issues can often lead solicitors to consider multiple expert instructions across closely related disciplines. This case study explores how INNEG identified a Consultant Neurologist with specialist expertise in Clinical Neurophysiology, helping avoid fragmented evidence and establish a more coherent expert approach from the outset.

A solicitor approached INNEG in relation to a complex neurological claim involving overlapping issues around seizure activity, diagnostic interpretation, and long-term functional impact. At the outset, it was anticipated that separate instruction would be required from both a Consultant Neurologist and a Consultant Neurophysiologist in order to address the full evidential picture.

However, progressing with multiple experts risked creating fragmented opinion across closely related clinical issues, particularly where causation and diagnostic interpretation would need to be considered together.

From the outset, a dedicated INNEG Analyst reviewed the case in detail, focusing not only on the disciplines initially requested, but on the specific medico-legal questions likely to sit at the centre of the claim.

Through this review, the Analyst identified that a Consultant Neurologist with specialist expertise in Clinical Neurophysiology could credibly address both the neurological and neurophysiological issues within a single, coherent opinion.

Rather than progressing with two separate experts, INNEG recommended a unified expert approach aligned to the central causation and evidential issues in dispute.

This enabled the solicitor to progress with a more cohesive evidential framework, reducing the risk of overlap, conflicting interpretation, or duplicated analysis between disciplines.

Importantly, the value extended beyond efficiency alone. By identifying an expert capable of addressing the full clinical picture, INNEG helped establish greater continuity and clarity within the expert evidence from the outset, supporting a more robust and defensible approach as the case progressed.

For complex neurological claims, identifying where specialist overlap exists can materially strengthen the structure and coherence of expert evidence. Through detailed case understanding and analyst-led expert strategy, INNEG helps ensure expert instruction is aligned not simply to discipline, but to the issues most likely to come under scrutiny.
