In cosmetic surgery claims, complexity does not always come from the procedure itself. It often comes from determining which expert evidence is actually needed and how those opinions should be structured from the outset.

INNEG was instructed on a complex cosmetic surgery matter involving allegations surrounding post operative complications, poor aesthetic outcome, and inadequate consent following elective breast surgery.

The solicitor initially anticipated the need for multiple experts across cosmetic surgery, scarring, and psychological impact due to the range of issues raised within the claim.

However, early over instruction can introduce unnecessary complexity, overlapping opinion, and evidential inconsistency, particularly in cosmetic claims where the distinction between expected outcome, recognised complication, and negligent treatment is often heavily disputed.

INNEG assigned a dedicated Analyst to the case, allowing the instruction to be reviewed in detail from both a clinical and evidential perspective. By taking time to understand the allegations, procedural history, and key areas likely to sit at the centre of breach and causation discussions, a more targeted expert strategy was identified.

Rather than progressing with several overlapping disciplines, INNEG advised that a single Consultant Plastic Surgeon with extensive cosmetic surgery experience could address the core issues coherently within one expert opinion.

Within 48 hours, a highly specialised expert was identified and nominated with directly relevant experience in cosmetic breast surgery, post operative complications, consent, and aesthetic outcome assessment.

This allowed the solicitor to:

  • Progress with a clearer and more strategically aligned expert structure
  • Avoid unnecessary overlap between multiple expert disciplines
  • Focus early on the key clinical and causation issues likely to influence the claim

Outcome

  • Specialist cosmetic surgery expert identified and nominated within 48 hours
  • Clearer and more streamlined expert strategy established at an early stage
  • Avoided unnecessary complexity and overlapping expert evidence
  • Expert instruction aligned directly to the central issues in dispute

By combining detailed case understanding with targeted expert identification, INNEG helped the solicitor move forward with a more focused and defensible evidential approach, reducing the risk of unnecessary complication as the claim progressed.
