When pharmaceutical negligence claims involve multiple interacting risk factors, the risk is not just delay. It is progressing with expert evidence that fails to address the full clinical and regulatory picture.

In this case, a fatal outcome following treatment for rheumatoid arthritis raised concerns around the combined effects of Methotrexate, Leflunomide, and sun exposure. Allegations centred on phototoxic skin damage leading to fatal infection, alongside scrutiny of the adequacy of patient risk warnings.

The issues spanned rheumatology, dermatology, and prescribing guidance. Without tightly aligned expertise from the outset, there was a clear risk that early opinion would not fully engage with causation or withstand challenge.

INNEG was instructed at this stage.

A dedicated analyst was assigned to the case, taking time to understand the specific clinical interactions, the regulatory context, and the evidential gaps that needed to be addressed. This allowed the instruction to be approached with precision rather than broad shortlisting.

Within three days, two Rheumatology experts were identified and nominated. Each was selected not simply for their discipline, but for their direct experience with the drug interactions in question, associated dermatological complications, and patient risk communication standards.

This avoided the common cycle of testing and replacing experts where initial instruction is not sufficiently aligned to the issues in dispute.

As a result, the legal team was able to:

  • Progress early case strategy with confidence in the relevance of the expert evidence
  • Engage with opinion that addressed both clinical causation and regulatory standards
  • Avoid disruption associated with misaligned or non-defensible expert instruction

Outcome

  • Two highly aligned expert nominations with directly relevant clinical and regulatory expertise
  • Expert instruction progressed within three days, maintaining momentum in a high-risk fatal claim
  • No need for re-instruction or revision of expert approach

By combining detailed case understanding with targeted expert identification, INNEG supported the legal team in moving forward with evidence that was both defensible and directly aligned to the issues in dispute, reducing the risk of challenge later in the claim.
